КАССАЦИОННЫЕ АКТЫ СУДЕБНЫХ КОЛЛЕГИЙ ВЕРХОВНОГО СУДА РФ: СВОЕОБРАЗНЫЙ СУДЕБНЫЙ ПРЕЦЕДЕНТ ИЛИ РЕКОМЕНДАТЕЛЬНАЯ СУДЕБНАЯ ПРАКТИКА

Аннотация. Целью статьи является анализ определений судебной юридической силы определений Верховного суда РФ, вынесенных в кассационном порядке, сложности и проблемы их использования в качестве ориентира в судебной практике, применены конкретно-научный, эмпирический, сравнительно-правовой и другие исследования, даны рекомендации по использованию на практике определений Верховного суда РФ вынесенных в кассационном порядке, даны предложения по совершенствованию законодательства в части обеспечения и формирования единства судебной практики, а также даны рекомендации по правильной определении формы судопроизводства, в соответствии с разъяснениями кассационных определений Верховного суда РФ.

CASSATION ACTS OF JUDICIAL COLLEGIUMS OF THE SUPREME COURT OF THE RUSSIAN FEDERATION: A KIND OF JUDICIAL PRECEDENT OR ADVISORY JUDICIAL PRACTICE

Annotation. The purpose of the article is to analyze the definitions of the judicial legal force of the rulings of the Supreme Court of the Russian Federation issued in cassation, the difficulties and problems of their use as a guideline in judicial practice, applied concrete scientific, empirical, comparative legal and other studies, recommendations on the use in practice of the rulings of the Supreme Court of the Russian Federation issued in cassation, given proposals for improving legislation in terms of ensuring and forming the unity of judicial practice, and also recommendations are given on the correct definition of the form of legal proceedings, in accordance with the explanations of the cassation rulings of the Supreme Court of the Russian Federation.
