СДЕЛКА КАК ОСОБЫЙ ВИД ЮРИДИЧЕСКИХ ДЕЙСТВИЙ

Аннотация. В статье рассматриваются закреплённые в дефиниции статьи 153 ГК РФ сущностные признаки понятия сделки. На основе анализа некоторых институтов делается вывод о достаточно широком изложении понятия сделки. Также исследуется место сделки в системе юридических и неюридических действий, воплощённой законодателем в нормах ГК РФ о посреднических договорах. В заключение предлагаются изменения, направленные на корректировку понятия сделки.

TRANSACTION AS A SPECIAL TYPE OF LEGAL ACTION

Annotation. The article discusses the essential features of the concept of a transaction fixed in the definition of Article 153 of the Civil Code of the Russian Federation. Based on the analysis of some institutions, the authors come to the conclusion about a fairly broad presentation of the concept of a transaction. The place of the transaction in the system of legal and non-legal actions embodied by the legislator in the norms of the Civil Code of the Russian Federation on intermediary contracts is also explored. In conclusion, changes aimed at correcting the concept of a transaction are proposed.
