Resolution of the Plenum No. 25, rulings in individual cases and Thematic Review No. 12\/2026 are compared. The analysis identifies a shift from verifying an isolated statutory defect of will to assessing its recognizability by the counterparty, the precise moment of the defect and the consequences of invalidity.
