ГЕНЕЗИС КАТЕГОРИИ «ДОБРОСОВЕСТНОСТЬ» В РИМСКОМ ЧАСТНОМ ПРАВЕ: BONA FIDES И ЕЁ ЭВОЛЮЦИЯ

Аннотация. Статья посвящена анализу зарождения, становления и развития категории добросовестности (bona fides) в истории римского частного права. Исследуется трансформация нравственно-этической идеи fides в самостоятельный правовой принцип, его роль в формировании преторского права и распространение в классический период. Особое внимание уделяется эволюции концепции от архаического и поздней республиканской эпохи к имперскому периоду и постклассическому праву. Анализируется влияние естественного права (ius naturale), права народов (ius gentium), философских учений стоицизма и позднее влияния христианства на содержание и применение принципа добросовестности. Выявляются закономерности трансформации категории на каждом историческом этапе развития римской правовой системы. Исследование основано на анализе источников римского права, трудов классических юристов и современных научных исследований.

THE GENESIS OF THE CATEGORY OF «GOOD FAITH» IN ROMAN PRIVATE LAW: BONA FIDES AND ITS EVOLUTION

Annotation. The article is devoted to the analysis of the origin, formation and development of the category of good faith (bona fides) in the history of Roman private law. The article examines the transformation of the moral and ethical idea of fides into an independent legal principle, its role in the formation of praetorian law and its spread in the classical period. Special attention is paid to the evolution of the concept from the archaic and late republican era to the imperial period and postclassic law. The influence of natural law (ius naturale), the law of nations (ius gentium), the philosophical teachings of Stoicism and later the influence of Christianity on the content and application of the principle of good faith is analyzed. The patterns of transformation of the category at each historical stage of the development of the Roman legal system are revealed. The study is based on an analysis of the sources of Roman law, the works of classical lawyers and modern scientific research
