АКТУАЛЬНЫЕ ПРОБЛЕМЫ СНОСА САМОВОЛЬНЫХ ПОСТРОЕК

Аннотация. Представленная научная статья посвящена выявлению актуальных правовых проблем сноса самовольных построек по российскому законодательству. Автором проводится комплексный анализ действующего правового регулирования, выявляются наиболее острые проблемы, возникающие в правоприменении, и рассматриваются примеры из судебной практики Верховного Суда Российской Федерации и иных инстанций. Особое внимание в работе уделено вопросам соблюдения баланса между публичными и частными интересами, предотвращению злоупотреблений как со стороны органов власти, так и застройщиков, а также правовым коллизиям, затрудняющим эффективное разрешение споров.

ACTUAL PROBLEMS OF DEMOLITION OF UNAUTHORIZED BUILDINGS

Annotation. The presented scientific article is devoted to the identification of actual legal problems of demolition of unauthorized buildings under Russian law. The author conducts a comprehensive analysis of the current legal regulation, identifies the most acute problems arising in law enforcement, and examines examples from the judicial practice of the Supreme Court of the Russian Federation and other instances. Special attention is paid to the issues of maintaining a balance between public and private interests, preventing abuse by both authorities and developers, as well as legal conflicts that make it difficult to effectively resolve disputes.
