As a result of the analysis carried out, the absence of a single law on social security in the Russian Federation, as well as a law on state pensions, is stated; the existence of laws that do not meet constitutional requirements, as well as the timing of pension payments, allowing them to be paid for the time spent, and not in advance, is critically assessed. In the preparation of the article, axiological, comparative legal and formal legal methods were used, the analysis of normative legal acts of the Russian Federation was carried out, the conclusions of some scientists were given. The conclusions that should form the basis for the preparation of the federal law on state pensions are formulated, as well as a variant of the academic definition of the concept of \u00abstate pension\u00bb is developed.<\/em><\/p>\n<p><strong><em>Key words:<\/em><\/strong> <em>The Constitution of the Russian Federation;
