D.I.<\/p>\n<p><strong>THE PRINCIPLE OF GOOD FAITH AND ABUSE OF LAW IN CIVIL LAW: THEORETICAL AND PRACTICAL ASPECTS<\/strong><\/p>\n<p><em><strong>Annotation.<\/strong><\/em><em>\u00a0<\/em><em>The article is devoted to a comprehensive anal<\/em><em>ysis of the principle of good faith and the institution of abuse of law in civil law, revealing their theoretical and legal nature, historical evolution and practical significance. The author explores the dualistic nature of good faith, which combines obje<\/em><em>ctive standards of justice and subjective criteria for the legality of behavior, as well as its role as a meta-principle integrating ethical and legal principles. Based on the comparative legal method, key approaches to understanding the abuse of law in th<\/em><em>e continental and Anglo-American traditions are identified, and the specifics of the Russian doctrine are emphasized, where abuse is interpreted as a paradox of a formally legitimate but socially harmful action. Special attention is paid to the discussions<\/em><em> in science: integrative, dualistic and &#171;mirror&#187; theories of the relationship between good faith and abuse of law, as well as the problem of evaluation categories in the context of their adaptive and balancing functions. The challenges of the digital age a<\/em><em>re theoretically justified, including the conflict between algorithmic formality and the requirements of fairness in smart contracts. The practical significance of the work lies in proposals for improving legislation.: legalizing the criteria of good faith<\/em><em>, introducing &#171;ethical modules&#187; into digital systems, and developing the methodology of judicial interpretation. The research contributes to the theory of civil law by offering a synthesis of dogmatic and sociological approaches to overcome regulatory gaps<\/em><em>.<\/em><\/p>\n<p><em><strong>Key
